What is a workplace under PoSH Act?

According to Section 2(o) of the PoSH Act, a workplace under PoSH Act is defined as:

  • According to section 2(o) “workplace” includes –any department, organization, undertaking, establishment, enterprise, institution, office, branch, or unit which is established, owned, controlled, or wholly or substantially financed by funds provided directly or indirectly by the appropriate Government or the local authority or a Government company.
  • The POSH Act clearly defines workplace as “any place visited by the employee arising out of or during the course of employment, including transportation provided by the employer for the purpose of commuting to and from the place of employment”

  • The place where any private enterprise, undertaking, establishment, society, trust, non-governmental organization, unit, or service provider organization, do any kind of commercial, professional, educational, entertainment, industrial, health services, or financial activities.
  • Where production, sale, distribution, or service is also included, it will be considered a workplace.
  • As per the provisions made under the Act, sports stadiums and institutes used by sports training institutes will also be considered workplaces.
  • A place of work also includes a residence or a house.
